The terms on which you may access and use this website and any information or services it provides.

1. Acceptance of Terms

These Terms of Use (the "Terms") govern your access to, and use of, the Vision Asset Group Pty Ltd website located at visionasset.com.au and any associated sub-domains (the "Site"). By accessing or using the Site you agree to be bound by these Terms, our Privacy Policy and any other policies referenced on the Site. If you do not agree, please do not use the Site.

3. Property Listing Information

Information published on the Site about properties for sale, lease, sold, or leased — including price guides, photographs, floor plans, addresses, sizes, inclusions, inspection times and auction dates — is provided in good faith and is believed to be accurate at the time of publication. However:

  • property details are subject to change without notice;
  • photographs, virtual tours, floor plans and digital staging may have been edited, enhanced or computer-generated and are indicative only;
  • price guides are estimates only and do not constitute an offer, valuation, or representation of the final sale or rental price;
  • land sizes, building sizes and dimensions are approximate and have been obtained from sources we believe to be reliable;
  • inclusions, fittings and fixtures may be subject to negotiation, exclusion, or change before settlement.

You must satisfy yourself by independent inspection and inquiry about every aspect of a property before entering into any contract or making any financial decision. We recommend obtaining your own legal, financial, building, pest and strata advice.

4. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, video, audio, software, source code, design, arrangement, and the "Vision Asset Group" name and trade marks (whether registered or unregistered) — is owned by Vision Asset Group or its licensors and is protected by Australian and international copyright, trade mark and other intellectual property laws. You may view, download and print pages from the Site for your personal, non-commercial use only. Any other use — including reproduction, modification, distribution, transmission, republication, display, performance, or commercial exploitation — is prohibited without our prior written consent.

5. Permitted Use

You may use the Site only for lawful purposes. You must not:

  • use the Site in any way that breaches any applicable Commonwealth, State or Territory law;
  • access, scrape, harvest or otherwise collect data from the Site using any automated means (including bots, spiders or crawlers) without our prior written consent;
  • introduce viruses, trojans, worms or other malicious code;
  • attempt to gain unauthorised access to any portion of the Site, our systems, or any account, server or network connected to the Site;
  • impersonate any person or entity, or misrepresent your identity or affiliation with any person or entity;
  • submit content that is false, misleading, defamatory, threatening, harassing, obscene, infringing of any third-party right, or otherwise unlawful; or
  • use the Site to send unsolicited commercial communications in breach of the Spam Act 2003 (Cth).

6. Property Enquiries and Tenancy Applications

Submitting a property enquiry, requesting an appraisal, applying for a tenancy, or completing any form on the Site does not create:

  • any binding contract to sell, purchase or lease a property;
  • any agency relationship; or
  • any obligation by Vision Asset Group or any property owner to accept your enquiry, application or offer.

Binding agreements for the sale or lease of property must be in writing, signed by all parties, and prepared in accordance with the applicable law in NSW. Tenancy applications are subject to owner approval, identity verification, reference checks and (where applicable) tenancy database checks described in our Privacy Policy.

7. Third-Party Links and Services

The Site may contain links to third-party websites, services or resources (for example real estate portals, mapping providers, payment processors). We provide these links for convenience only. We do not control, endorse or assume responsibility for the content, products, services or practices of those third parties. Your use of any third-party service is at your own risk and subject to that third party's terms and policies.

8. Australian Consumer Law

Certain consumer guarantees apply under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and other consumer protection laws. Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under those laws that cannot be lawfully excluded.

9. Disclaimer and Limitation of Liability

Subject to clause 8, and to the maximum extent permitted by law:

  • the Site and all information, materials and services made available through it are provided on an "as is" and "as available" basis, without warranties or representations of any kind, whether express or implied;
  • we do not warrant that the Site will be uninterrupted, error-free, secure, free of viruses or other harmful components, or that the content will be accurate, complete or current;
  • we exclude all liability for any direct, indirect, incidental, special, consequential or exemplary loss or damage (including loss of profits, loss of business, loss of data, or loss of opportunity) arising from or in connection with your use of the Site, even if we have been advised of the possibility of such loss;
  • where any liability cannot be excluded under the Australian Consumer Law, our liability is, at our option, limited to (a) re-supplying the relevant service or (b) paying the cost of having the service re-supplied.

10. Indemnity

You agree to indemnify Vision Asset Group Pty Ltd, its officers, employees, contractors and agents against all loss, damage, liability, costs and expenses (including reasonable legal costs) arising out of any breach by you of these Terms, any misuse of the Site by you, or any infringement of any third-party right or applicable law caused by you.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which forms part of these Terms.

12. Trust Account and Regulatory Compliance

All trust account dealings and agency conduct are governed by the Property and Stock Agents Act 2002 (NSW), the Property and Stock Agents Regulation 2014 (NSW), and other applicable laws. Trust account audit reports are available in accordance with the Act on reasonable notice and to persons entitled to receive them.

13. Suspension and Termination

We may, at any time and without notice, modify, suspend or discontinue any part of the Site, or restrict your access to all or part of the Site, if we reasonably believe you have breached these Terms or any applicable law.

14. Changes to these Terms

We may amend these Terms from time to time. The current version is always available on this page with the effective date shown at the top. Your continued use of the Site after the changes take effect constitutes your acceptance of the amended Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You and Vision Asset Group Pty Ltd submit to the exclusive jurisdiction of the courts and tribunals of New South Wales and the Commonwealth of Australia for all matters arising out of or in connection with these Terms or the Site.

16. Severability

If any provision of these Terms is held to be invalid, unenforceable or illegal for any reason, the remaining provisions shall continue in full force and effect.
